Exclusive rights to a trademark arise from the date the Registration Certificate is issued. However, the filing date of the application is important, as it is this date that establishes your priority.

Can I use the designation (logo/name) in business immediately after filing an application for TM registration?

Yes, you can start using the designation. However, you do so at your own risk until you receive the certificate. If during the examination a similar, previously filed TM is discovered, your registration may be refused.

I found a similar registered trademark in another country. Will this affect my registration in Ukraine?

No, in most cases it will not. Trademark registration in Ukraine provides protection only within the territory of Ukraine. Registrations in other countries are not grounds for refusal unless the foreign trademark has an international registration extended to Ukraine or is recognized as well-known in Ukraine.

What should I do if I discover that a competitor is unlawfully using my registered trademark?

You have the exclusive right to prohibit such use. The first step is usually to send a cease-and-desist letter demanding that the infringement stop immediately. If this does not resolve the issue, you have the right to take the matter to court.
