Cooperation with the International association for the protection of intellectual property (AIPPI)

General information about the organization

AIPPI (International Association for the Protection of Intellectual Property) is a global, non-profit association dedicated to the development of intellectual property (hereinafter – IP). Founded in 1897, AIPPI is the world’s leading organization focused on the improvement and promotion of IP protection at both international and national levels. To achieve this goal, the association engages in the development, expansion, and refinement of international and regional treaties and agreements, as well as national laws related to IP.

AIPPI positions itself as a politically neutral, non-profit organization headquartered in Switzerland, with over 8,000 members from more than 110 countries. Its members include lawyers, patent attorneys, patent agents, trademark agents, as well as judges, academics, engineers, and corporations interested in IP protection on both national and international levels.

Sergiy Barbashyn’s membership in the association

Sergiy Barbashyn is an active member of the International Association for the Protection of Intellectual Property (AIPPI) and participates in the work of its Trademark Committee.

As part of his work in this committee, Sergiy Barbashyn contributes to the development and analysis of international standards and recommendations for trademark protection, as well as the exchange of experience with colleagues from various countries. In October 2023, he represented Ukraine at the AIPPI Annual Congress in Istanbul, where the issue of trademark use verification was discussed. During the event, a resolution was adopted that established key approaches to proving the use of trademarks for goods and services, including the absence of quantitative and time limitations for evidence and the acceptability of various types of proof.

Additionally, in February 2023, Sergiy Barbashyn was a speaker at the international webinar “Video Games and Intellectual Property in Europe,” organized by the IP Committee of the Ukrainian National Bar Association (UNBA) in cooperation with AIPPI. The discussion focused on issues related to the identification and transfer of intellectual property rights in the IT sector, the protection of video game components, as well as strategies for judicial and alternative dispute resolution in European countries.

Through his active participation in AIPPI events, Sergiy Barbashyn contributes to strengthening international cooperation and the exchange of experience in the field of intellectual property, playing a crucial role in the development of Ukraine’s legal community.

Article on the state of intellectual property in Ukraine under martial law

On February 2, 2024, AIPPI published an article titled “Intellectual property protection in Ukraine during the war”, authored by Sergiy Barbashyn. The purpose of the article was to inform the global intellectual property rights protection community about the state of this sector in Ukraine during the war.

The article provides an analysis of the legal mechanisms and specific features of IP rights protection under martial law in Ukraine. It highlights changes in the work of the national IP authority, including the reorganization of Ukrpatent and the establishment of a fully-fledged national IP office, which contributes to procedural transparency and more effective rights protection.

Overall, the article offers a comprehensive overview of the legal aspects of IP in Ukraine during the martial law period, incorporating the most recent legislative changes at the time and practical recommendations for rights holders.
