Mobilization and Military Registration: Analysis of Draft Law №10449

On January 30, 2024, the Verkhovna Rada registered a new draft law, №. 10449, which proposes changes to military service, mobilization, and registration. Let’s take a look at the fundamental changes.

Fundamental Changes Regarding Military Service, Mobilization, and Military Registration:

1. The conscription age is planned to be lowered from 27 to 25 years.

2. The responsibilities of persons liable for military service have been expanded, including:

🔹 registration of an electronic cabinet for persons liable for military service, accessible to the Ministry of Defense, the Security Service of Ukraine, intelligence agencies, operational commands, as well as the territorial community centers and joint ventures of the regions;

🔹 the requirement to possess a military registration document along with an identity document;

🔹 clarification of credentials is required within 60 days from the start of mobilization.

3. The requirements for the content of the call-up notice are defined, and it is envisaged that the notice may be served through the electronic office of the person liable for military service.

4. Persons liable for military service who have voluntarily arrived at the territorial community centers and joint ventures are sent for training (preparation) in connection with the call-up within 2 months from the preliminary military qualification examination date.

5. The grounds for granting a postponement during mobilization have been specified, in particular:

🔹 in connection with release from captivity;

🔹 family members of the first degree of kinship (parents, spouse, children) who take care of a person with a disability of group I;

🔹 persons who have a child under the age of 18 if the second parent of such a child is deceased, deprived of parental rights, recognized as missing or unaccountably absent, or declared dead;

🔹 vocational (vocational-technical), professional pre-higher and higher education students who study full-time or dual forms of education and obtain a higher education level than the previously obtained one.

6. The deferment for the following persons has been canceled:

🔹 those who have a spouse with a disability and/or one of their parents or their spouse’s parents who are disabled persons of groups I or II.

🔹 employees of certain state bodies, including the National Police.

7. The list of rights and obligations of employees of the Territorial Defense Forces (TCC) and Joint Forces (JV) and police officers has been expanded to include:

🔹 photo and video recording of the process of presenting and verifying documents.

🔹 administrative detention and transfer to Military Commissariats and Joint Information Centers of persons for violating the rules of military registration.

8. Restrictions on persons liable for military service include:

🔹 Seizure of bank accounts and valuables held in banks or electronic money.

🔹 Temporary restriction on the right to travel outside Ukraine.

🔹 Temporary restriction on the right to drive a vehicle.

9. Conscript military service has been abolished. Instead, basic military training is proposed to be introduced, with all conscripts being discharged from service to the reserve.

10. Consular actions in foreign diplomatic missions of Ukraine (issuance of powers of attorney, certificates, etc.) for men aged 18 to 60 years are subject to the availability of military registration documents.

11. Heads of healthcare institutions are obliged to inform the Territorial Defense Forces and Joint Forces about citizens aged 18 to 25 who are undergoing inpatient treatment.
